Effective Date: August 21, 2026
GENISCi LLC, operating as GENISCi Health and Wellness
Version: 1.1
Your Information. Your Rights. Our Responsibilities.
This Notice describes how medical and other protected health information about you may be used and disclosed by GENISCi Health and Wellness, how you may obtain access to this information, and the rights you have regarding your health information.
Please review this Notice carefully.
GENISCi Health and Wellness is committed to protecting the privacy, confidentiality, integrity, and security of the health information entrusted to us and to complying with applicable federal and Virginia privacy requirements.
Your Rights
When it comes to your health information, you have certain rights. GENISCi will assist you in exercising these rights as required by law.
Get an electronic or paper copy of your health information
You may ask to see or obtain an electronic or paper copy of your medical record and other health information that GENISCi maintains about you.
We will respond within the time required by applicable law and may charge a reasonable, cost-based fee when permitted.
Virginia law also gives individuals rights concerning access to their health records, including, when specifically requested and legally applicable, an audit trail of additions, deletions, or revisions to the record. Virginia also permits individuals to request that their records be disclosed to another health care entity in an available format.
Ask us to correct your health information
You may ask GENISCi to correct health information about you that you believe is incorrect or incomplete.
We may deny a request in circumstances permitted by law, but if we do, we will provide the explanation required by applicable law.
Request confidential communications
You may ask us to contact you in a specific way—for example, at a particular telephone number—or to send communications to a different address.
We will accommodate reasonable requests as required by law.
Ask us to limit what we use or disclose
You may ask us not to use or disclose certain health information for treatment, payment, or health care operations.
We are not always required to agree. If we do agree, we will comply with the restriction except where disclosure is otherwise permitted or required by law, including when information is needed for emergency treatment.
If you pay in full out of pocket for a health care service or item, you may ask us not to disclose information about that service or item to your health plan for payment or health care operations. We will honor that request unless disclosure is required by law.
Get an accounting of certain disclosures
You may request an accounting of certain disclosures of your protected health information during the period prescribed by law. Certain disclosures are excluded from this accounting requirement, including many disclosures for treatment, payment, and health care operations.
Get a copy of this Notice
You may request a paper copy of this Notice at any time, even if you previously agreed to receive it electronically.
Choose someone to act for you
If another person has legal authority to act on your behalf—such as through a valid health care power of attorney, advance directive, guardianship, or other lawful authority—that person may exercise your privacy rights to the extent permitted by law.
GENISCi may require documentation establishing that authority before acting on a request.
File a privacy complaint
You may file a complaint if you believe your privacy rights have been violated.
GENISCi will not retaliate against you for filing a privacy complaint.
Your Choices
For certain uses and disclosures of health information, you may tell us your preferences.
These situations may include sharing information with family members, friends, caregivers, or others involved in your care or payment for your care, and sharing information in connection with disaster-relief activities.
If you are unable to communicate your preference, we may disclose information when permitted by law and when, using appropriate professional judgment, we believe the disclosure is in your best interest or is necessary to prevent or lessen a serious and imminent threat to health or safety.
Uses requiring written authorization
We will obtain your written authorization before using or disclosing protected health information when authorization is required by law, including for:
• most uses or disclosures for marketing;
• the sale of protected health information; and
• most disclosures of psychotherapy notes.
You may revoke an authorization in writing at any time, except to the extent GENISCi has already acted in reliance upon it.
If GENISCi engages in fundraising activities involving protected health information, we will comply with applicable notice and opt-out requirements.
How We May Use and Disclose Your Health Information
Treatment and care coordination
We may use and disclose health information to provide, coordinate, or manage your care and health services.
Information may be shared, as legally appropriate, among nurses, physicians, therapists, other registered or licensed clinicians, authorized care-team members, and other health care providers involved in your skilled care, treatment, rehabilitation, whole-health support, or care coordination.
Health care operations
We may use and disclose health information to operate GENISCi Health and Wellness and support the quality, safety, effectiveness, and administration of our services.
This may include clinical supervision, quality assessment and improvement, professional review, credentialing, training, compliance activities, auditing, care coordination, safety, business management, privacy and security activities, technology operations, and other lawful health care operations.
Payment
GENISCi currently provides its services primarily on a private-pay basis.
We may nevertheless use and disclose health information as necessary to bill for and obtain payment for services, including billing you, another responsible payer, or, when applicable in the future, a health plan or other payment source.
Public health and safety
We may disclose health information when permitted or required by law for public-health or safety purposes, including activities involving disease prevention and reporting, adverse events, suspected abuse, neglect or exploitation, and prevention or reduction of a serious threat to health or safety.
Research
We may use or disclose health information for research only when permitted under applicable law and after required authorizations, waivers, privacy protections, or other approvals have been satisfied.
Compliance with law and health oversight
We may disclose health information when federal or Virginia law requires or permits us to do so, including disclosures to health oversight agencies, licensing authorities, accreditation organizations, or other authorized governmental or regulatory bodies.
Workers’ compensation and governmental functions
We may use or disclose health information for workers’ compensation matters or other governmental functions when permitted or required by law.
Law enforcement and legal proceedings
We may disclose health information in response to lawful court or administrative orders, subpoenas, search warrants, governmental requests, or other legal processes when applicable legal requirements have been satisfied.
Medical examiners, coroners, funeral directors, and organ donation
When authorized by law, we may disclose health information to medical examiners, coroners, funeral directors, organ-procurement organizations, tissue banks, or other authorized organizations. These categories track the principal permitted-use categories in HHS’s current health-care-provider model NPP.
Additional Protections Under Virginia Law
Federal HIPAA requirements establish important privacy protections. Virginia law may impose additional or more protective requirements. When applicable Virginia law provides greater privacy protection, GENISCi follows the more protective requirement.
Confidentiality and redisclosure
Virginia recognizes an individual’s right of privacy in the contents of health records. Health care entities generally may not disclose health records except as permitted or required by law.
Virginia also restricts further disclosure of health records beyond the purpose for which they were originally disclosed unless specific authorization or another legal basis permits the subsequent disclosure.
Client records maintained by GENISCi
As a Virginia-licensed Home Care Organization, GENISCi is required to maintain an organized client-record system.
Virginia HCO regulations require client-record information to be safeguarded against loss or unauthorized use, require client records to remain confidential, and limit access to authorized personnel in accordance with state and federal law.
HIV-related information
Virginia law specifically requires the results of HIV testing to remain confidential and permits disclosure only to persons or entities authorized under applicable federal or state law.
Records involving minors
Virginia law provides special rules concerning minors’ authority to consent to certain health services and control related medical records.
For specified services—including certain infectious-disease services, birth control or pregnancy-related services, outpatient substance-use treatment, and outpatient mental-health treatment—a minor may be treated as an adult for purposes of consent and may also have authority to access or authorize disclosure of records relating to those services.
GENISCi will evaluate access to and disclosure of minors’ health information in accordance with applicable federal and Virginia law.
Psychotherapy notes and specially protected information
Certain categories of health information—including psychotherapy notes and other records receiving enhanced protection under federal or Virginia law—will be used or disclosed only when the applicable legal requirements have been met.
Substance Use Disorder Patient Records
To the extent GENISCi creates, receives, or maintains substance-use-disorder patient records protected by 42 CFR Part 2, additional federal confidentiality protections apply.
GENISCi will not use or disclose Part 2-protected information in civil, criminal, administrative, or legislative investigations or proceedings against you unless federal requirements have been satisfied, including, when applicable, your written consent or an appropriate court order and subpoena.
As of February 16, 2026, HHS requires HIPAA covered providers that create or maintain Part 2 records to include Part 2 information in their NPPs.
